The term is negotiated rather than capped by statute. Florida law regulates which relationship you are in, not how long the agreement runs, so the end date is entirely yours to track.

Florida Realtors publishes four versions of the Exclusive Buyer Brokerage Agreement, one for each brokerage relationship: single agent, transaction broker, single agent with consent to transition to transaction broker, and no brokerage relationship.

That structure exists because of section 475.278. Every licensee is presumed to be a transaction broker unless a single agent or no-brokerage relationship is established in writing, so the version you sign is what moves you off the default.

The forms were revised to meet the NAR settlement requirements. The 2026 update to the consent-to-transition version (EBBA-8tn) added an audio and visual acknowledgement for the buyer, since recording devices are now common in homes, and removed language about the broker running credit checks.

Use it when

  • You are establishing an exclusive buyer relationship in Florida
  • You need the written record that sets the relationship type
  • You may later need consent to transition from single agent to transaction broker

Not for

  • Deciding your relationship type after the fact. Silence makes you a transaction broker.
  • Moving a client between relationship types without their prior written consent.
